MyIDCare Credit Edition Terms Of Service (TOS)

Introduction

This Benefits Description contains the terms and conditions of your benefits coverage with ID Experts. Please read this material carefully. If you have any questions about the Program or your benefits, please contact us.

When Your Benefits Start

Your benefits begin on the effective date stated in the welcome letter, which accompanied this Benefits Description.

When Your Benefits End

Your benefits are in effect for exactly 1 year after the effective date stated in the welcome letter.

Description of Benefits

  1. DEFINITIONS (used in this Benefits Description )
    1. "Program" means the MyIDCare Credit Edition Program of personalized identity theft protection and recovery services and loss reimbursement.
    2. "Identity Theft Event" means the theft of a Participant's personal identification, including a Social Security number or other identifying information about the Participant, which has or could reasonably result in the wrongful use of such information, including, but not limited to, identity theft events occurring on or arising out of the Participant's use of the Internet. The Identity Theft Event shall not include the theft or wrongful use of the Participant's business name, d.b.a., or any other identifying information related to any business activity of the Participant. All losses resulting from the same, continuous, related, or repeated acts shall be treated as arising out of a single Identity Theft Event occurring at the time of the first such Identity Theft Event.
    3. "We," "us," and "our" mean ID Experts.
    4. "You" and "your" mean a member with benefits coverage under the Program.
    5. "Allowable expenses" means those incurred by you and fitting the definition of "costs" as set forth in the Personal Internet and Identity Coverage Insurance Policy ("PIIC") issued by Chartis Specialty Insurance Company.
    6. "Participant" means a member by the Program.
  2. PROGRAM COVERAGE
    The Program includes personalized identity theft protection and recovery services provided by ID Experts, together with the PIIC Policy provided by Chartis Specialty Insurance Company. The following is a list of the benefits for which you are eligible:
    1. Identity Theft Protection Benefits
      1. Protection Test. We offer a Protection Test to all Participants. The test is available in the Member Services section of our Web site.
      2. Protection Plan. When you take the Protection Test on our Web site, you automatically receive a customized Protection Plan based upon your responses.
      3. Credit Monitoring. We provide a link in the Member Services section of our Web site to activate your monitoring services. The monitoring service utilizes TransUnion credit data. It is offered exclusively to the member who enrolled in the Program, and not to the spouse or dependents of the member. Some Family plans do include monitoring service for the spouse or domestic partner. If changes to your personal information are detected, you will be notified via email alert, or US Postal Service if no email address is provided. If you recognize the changes, no action is required. If you do not recognize the changes, this may indicate someone is trying to assume your identity.
      4. Personal Protection Advisory newsletter. Members will receive a monthly Personal Protection Advisory newsletter via email. 
    2. Identity Theft Recovery Benefits
      If you discover that you are a victim of identity theft while enrolled in the Program, we will assign a Recovery Advocate to manage your case and activate the members of our Recovery Team needed to help with the recovery process. They will create a Damage Assessment and Recovery Plan based on your case. The Recovery Plan will outline the actions that you and the Recovery Team will need to take to complete the recovery process. Your cooperation in completing the Recovery Plan is a condition of the continued involvement of the Recovery Advocate and the Recovery Team.
    3. Identity Theft Lost Income and Expense Reimbursement
      Participants who discover that they are victims of identity theft while enrolled in the program will have their allowable costs for lost wages, legal defense fees and expenses (e.g., credit reports, legal fees for some civil suits, fees for refiling loan applications, etc.) associated with the identity theft event reimbursed through the PIIC Policy up to the Policy limits. There is no deductible applicable to the reimbursement. Reimbursement is subject to review of the expenses and lost income you submit.
    4. Unauthorized Electronic Fund Transfer Reimbursement
      Participants who are victims of identity theft will be reimbursed the principal amount, exclusive of interest and fees, incurred by you and caused by an Unauthorized Electronic Fund Transfer. Stolen Funds Loss shall not include any amount for which you did not seek reimbursement from the financial institution which issued the access device and holds the account from which funds were stolen, and stolen funds loss shall not include any amount for which you received reimbursement from any source.
    5. Identity Theft Reporting Time Limitation
      The identity theft event must be reported to us as soon as you become aware of it, but in no event later than 90 days after it is discovered by you. You will only be eligible for the recovery and reimbursement benefits if the identity theft event is reported to us within 90 days of discovery.
  3. PROGRAM COVERAGE EXCLUSIONS
    1. You will not be covered if the identity theft event occurs after termination of your membership in the Program. If you want assistance with the recovery process for a post-membership identity theft event, you can purchase recovery services from us by paying the standard fees, plus expenses.
    2. Participants must abide by all applicable State and Federal laws, and report illegal activities and fraud to appropriate legal authorities. Failure to do so will terminate their membership and all Program benefits.

Submitting Your Reimbursement Request and Receiving Payment

If you become a victim of an Identity Theft Event, you should notify us as soon as possible. Keep track of your expenses and time spent during your normal working hours dealing with the recovery process. (You should also get and retain receipts whenever applicable). You will need to submit a Claim Form (which we will provide). We will then submit the claim form to the Claims Department within 14 days of the closure of your case. You will receive reimbursement for your allowable expenses and lost income after your case closes.

Benefits Coordination with Other Theft Coverage

The Program's lost income and expense reimbursement services are available to you even if you have identity theft insurance with another company. For example, homeowner’s policies and credit card companies frequently provide such coverage. However, if you become a victim of an Identity Theft Event, you must seek reimbursement from that company first, up to its policy limits. Then, if you do not receive full reimbursement of your expenses and lost income associated with the recovery process under that coverage, you would be eligible to receive the difference, up to the limits of and subject to the terms and conditions of the PIIC Policy.

ID Experts will notify Participants, by posting notices on this site or by e-mail, of scheduled maintenance or upgrade work that may make the ID Experts Member Services section of this Web site unavailable for more than two hours. ID Experts does not warrant that the Member Services section of this Web site will be available on a continual 24-hour basis. The Participant acknowledges that the traffic of data through the Internet may cause delays during the download of information from the ID Experts Member Services section of this Web site and shall not hold ID Experts liable for delays that are ordinary in the course of Internet use.

Intellectual Property Ownership

Trademarks, Copyrights and Restrictions: ID Experts, the ID Experts logo, and ID Experts MyIDCare Credit Edition are trademarks of ID Experts. Everything you see in any promotional materials is copyrighted by ID Experts unless otherwise specified. All other product names and company logos found on promotional materials are the trademarks of their respective owners. All promotional materials are protected by copyrights, which are owned or licensed by ID Experts. You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way whatsoever any ID Experts information without the express, written consent of ID Experts.

Choice of Law

This Agreement shall be construed and controlled by the laws of the state of Oregon. Any dispute concerning or breach of the terms of this Agreement will be governed by the laws of the state of Oregon.

Indemnification

You agree to indemnify, defend and hold ID Experts and any of its affiliates and all of their agents, directors, employees, information providers and licensors and licensees harmless from and against any and all liability and costs (including attorneys' fees and costs) incurred by any of these parties in connection with any claim arising out of any breach by you of these terms and conditions. In the event that either (a) you are the subject of claims for which you properly seek damages from us under these terms and conditions, or (b) we are subject to any claim for which we have the right to be indemnified by you, we reserve the right at our expense in the case of claims in clause (a) and at your expense in the case of claims in clause (b), to assume the exclusive defense and control of any such claim, and you will not in any event settle any such claim without our written consent.

Entire Agreement/Modification

These Terms of Use constitute the entire agreement between ID Experts and the Participant with respect to the Participant's use of this Web site. This agreement supersedes any and all other agreements, either oral or written, between the Participant and ID Experts with respect thereto. ID Experts may, from time to time and at its sole discretion, modify, amend, or otherwise alter the terms and conditions of these Terms of Use and the content of this Web site. The terms and conditions in effect at the time of the Participant's use of this Web site shall govern such use.

Arbitration

The Participant agrees to have any unresolved claim or dispute submitted to binding arbitration for resolution. Such arbitration shall take place in Portland , Oregon , and shall be conducted in accordance with the rules of the American Arbitration Association in effect at that time.

Change of Terms

We may revise this Agreement at any time. However, we may not make any changes retroactive. We will notify you of any changes at the e-mail address or mailing address associated with your account. If you do not contact ID Experts and express your objection to our changes within thirty (30) days of receiving this notice, you shall be deemed a continuing use client and agree to be bound by any such revisions. If you fail to comply with any of these terms and conditions, we may at any time terminate your rights under this agreement.

Miscellaneous

These terms and conditions may not be altered, supplemented, or amended by you by the use of any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for the Service which is subject to additional or altered terms and conditions will be null and void, unless agreed to in writing and signed by you and ID Experts. The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference will be derived therefrom. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and shall not affect the enforceability of any other provision.

Description of Subscriber Obligations

You agree that you are only providing your own personal information and not the information of any other individual. You agree that the information you provide during the registration process and any subsequent information you provide to ID Experts will be true, accurate, and current. YOU ARE OBLIGATED TO CONTACT ID EXPERTS MEMBER SERVICES IN THE EVENT THAT ANY INFORMATION YOU HAVE PROVIDED ID EXPERTS HAS CHANGED.
You agree that you are eighteen (18) years of age or older.
You agree to pay us the fee we publish for our Service, less any discounts to which you may be entitled.

Agreement Assent

YOU AND ID EXPERTS HAVE ENTERED INTO THIS AGREEMENT, WHETHER ELECTRONICALLY, BY RECORDED VOICE AUTHORIZATION, OR VIA PHYSICAL COPY, INTENDING TO BE BOUND BY YOUR ACCEPTANCE OF THE AGREEMENT. IN THE FUTURE, YOU AGREE TO BE BOUND TO THESE SPECIFIC TERMS AND CONDITIONS OF SALES, AND MODIFICATIONS TO THIS AGREEMENT, BY CONTINUING TO USE OUR SERVICE AFTER WE HAVE NOTIFIED YOU OF THOSE TERMS AND CONDITIONS. NOTIFICATIONS, OR ANY OTHER COMMUNICATIONS, INCLUDING BILLING, PAYMENT, AND/OR DISCLOSURES WILL BE MADE VIA THE MAIL, TELEPHONE, OR EMAIL ADDRESS ASSOCIATED WITH YOUR ACCOUNT. THIS AGREEMENT MAY BE PRINTED OR RETAINED BY YOU FOR FUTURE REFERENCE.

Acknowledgment

The Agreement, including all documents referred to herein, represents the entire understanding between you and ID Experts regarding your relationship with ID Experts and supersedes any prior statements or representations. When using or purchasing the ID Experts Service, you agree to be bound by these terms and conditions. Thank you for your business.

INSURANCE POLICY AGREEMENT

Summary Description of Benefits for the Personal Internet & Identity Coverage Master Policy

This Summary is provided to inform you that as a member of ID Experts, you are entitled benefits under the Master Policy referenced below. Identity theft insurance underwritten by subsidiaries or affiliates of American International Group, Inc. The description herein is a summary and intended for informational purposes only and does not include all terms, conditions and exclusions of the policies described. Please refer to the actual policies for terms, conditions, and exclusions of coverage. Coverage may not be available in all jurisdictions.
The Personal Identity Coverage Master Policy has been issued to: ID Experts (the "Master Policy Holder"), Policy Number: 916252 underwritten by subsidiaries or affiliates of American International Group, Inc.

General Information

Should you have any questions regarding the Membership Program provided by ID Experts, or wish to view a complete copy of the Master Policy, please call ID Experts Member Services at 877-534-5972.

Limit of Insurance

Aggregate Limit of Insurance: $1,000,000 per policy period
Lost Wages: $7,500 per week, for 4 weeks maximum
Deductible $ 0 per policy period

Filing a Claim

To learn how to file a claim under the Master Policy, please call ID Experts Member Services at 877-534-5972.
This is a group master policy issued to ID Experts. If this master policy is terminated, your benefits will cease effective that date. It is the obligation of ID Experts to inform you of any termination of the master policy.

BENEFITS

We shall pay you for the following:
  1. Costs
    1. Reasonable and necessary costs incurred by you in the United States for re-filing applications for loans, grants or other credit instruments that are rejected solely as a result of a stolen identity event
    2. Reasonable and necessary costs incurred by you in the United States for notarizing affidavits or other similar documents, long distance telephone calls and postage solely as a result of your efforts to report a stolen identity event and/or amend or rectify records as to your true name or identity as a result of a stolen identity event;
    3. Reasonable and necessary costs incurred by the insured for up to six credit reports from established credit bureaus (with no more than two reports from any one credit bureau) dated within 12 months after your knowledge or discovery of a stolen identity event.
  2. Lost WagesActual lost wages that would have been earned in the United States, whether partial or whole days, for time reasonably and necessarily taken off work and away from the insured's work premises solely as a result of the insured's efforts to amend or rectify records as to the insured's true name or identity as a result of a stolen identity event. Actual lost wages includes remuneration for vacation days, discretionary days, floating holidays, and paid personal days and excludes business interruption or future earnings of a self-employed professional. Computation of lost wages for self-employed professionals must be supported by and will be based on prior year tax returns. Coverage is limited to wages lost within 12 months after the insured's discovery of a stolen identity event.
  3. Legal defense fees and expensesReasonable and necessary fees and expenses incurred in the United States by you with our consent for an attorney approved by us for:

    1. Defending any civil suit brought against you by a creditor or collection agency or entity acting on behalf of a creditor for non-payment of goods or services or default on a loan as a result of a stolen identity event; and
    2. Removing any civil judgment wrongfully entered against you as a result of the stolen identity event. A stolen identity event is the theft or your personal identification, social security number, or other method of identifying you, which has or could reasonably result in the wrongful use of such information, including but not limited to stolen identity events occurring on or arising out of your use of the Internet. A stolen identity event does not include the theft or unauthorized or illegal use of your business name, d/b/a or any other method of identifying your business activity.
  4. Unauthorized Electronic Fund Transfer Reimbursement
    1. You will be reimbursed, the principal amount, exclusive of interest and fees, incurred by you and caused by an Unauthorized Electronic Fund Transfer. Stolen Funds Loss shall not include any amount for which you did not seek reimbursement from the financial institution which issued the access device and holds the account from which funds were stolen, and stolen funds loss shall not include any amount for which you received reimbursement from any source.
    2. Unauthorized Electronic Fund Transfer means an Electronic Fund Transfer from your account initiated by a person other than you without the actual authority to initiate the transfer and from which you receive no benefit. An Unauthorized Electronic Fund Transfer does not include an Electronic Fund Transfer initiated: (1) by a person who was furnished the access device to your account by you, unless you had notified the financial institution that transfers by such person were no longer authorized; (2) with fraudulent intent by you or any person acting in concert with you; or (3) by the financial institution or its employee.


Coverage Scope

The Master Policy provides benefits to you only if you or ID Experts report a Stolen Identity Event or an Unauthorized Electronic Fund Transfer to us as soon as you become aware of a Stolen Identity Event or Unauthorized Electronic Fund Transfer, but in no event later than 90 days after the Stolen Identity Event or Unauthorized Electronic Fund Transfer is discovered by you.
In addition, you or the Master Policyholder on your behalf must follow the instructions provided. These instructions will include notifying major credit bureaus, the Federal Trade Commission�s Identity Theft Hotline and appropriate law enforcement authorities. A claim form will also instruct you how to file for benefits under the policy if the Stolen Identity Event or an Unauthorized Electronic Fund Transfer results in losses covered under the Master Policy.
You will only be covered if a Stolen Identity Event or Unauthorized Fund Transfer first occurs while you are a member of the Master Policyholder�s Membership Program and is reported to us within ninety (90) days after your discovery of a Stolen Identity Event or Unauthorized Fund Transfer. You will not be covered if the Stolen Identity Event or Unauthorized Fund Transfer first occurs after expiration or termination of the Master Policy or termination of your membership in the Master Policyholder�s Membership Program.

Limits Of Insurance

The most we shall pay you are the Limits of Insurance shown above. All Legal Costs shall be part of and subject to the Aggregate Limit of Insurance. LEGAL COSTS ARE PART OF, AND NOT IN ADDITION TO, THE LIMIT OF INSURANCE.
The Lost Wages Limit of Insurance shown above is a sublimit of the Aggregate Limit of Insurance and is the most we shall pay you for lost wages.

Deductible

1. There is no deductible

Other Insurance

We shall be excess over any other insurance, including, without limitation, homeowner's or renter's insurance. If you have other insurance that applies to a loss under this policy, the other insurance shall pay first. This policy applies to the amount of loss that is in excess of the Limit of Insurance of your other insurance and the total of all your deductibles and self-insured amounts under all such other insurance. In no event shall we pay more than our Limits of Insurance as shown above.

DUPLICATE COVERAGES

Should you be enrolled in more than one membership program insured by us, or any of our affiliates, we will reimburse you under each membership program:
  1. subject to the applicable deductibles and limits of liability of each insured membership program
  2. but in no event shall the total amount reimbursed to you under all membership programs exceed the actual amount of loss.
