Terms of Service

These terms of service and any document referred to within them (collectively, the "Terms of Service") set out the terms on which Where Are You Now Limited ("Company", “WAYN”, “WAYN Hotels”, “Where Next? ™”, "we", "us" or "our") provides access to an incentive program (WAYN Hotels Referral Program v1(September 2015) related to the invitation and registration of new users to the WAYN service through our website www.wayn.com or any app we release which allows you to access the booking services we provide (collectively, the "Service").
This document is in addition to our general Terms & Conditions, our Travel Booking Terms of Service, as well as our Privacy and Cookie Policies and other Terms of Service. You may review any or all of these documents by visiting http://www2.wayn.com/terms at any time.
Please read these Terms of Service carefully before using the Service. When you use the Service to create referrals and invite others to join and/or book a hotel via WAYN, you will be invited to agree to these Terms of Service. If you do not agree to these Terms of Service you must not use the Service.
  1. A member who refers the service to others may send an invite code or referral link with a Travel Voucher in one currency, any person who subsequently decides to join using that invite link or referral code may be designated a Travel Voucher in a different currency, with a different value that may not be exactly equal to the original Travel Voucher value due to fluctuations in foreign exchange rates or rounding.
  2. If your account is suspended permanently due to an infringement of any of our Terms & Conditions, you will forfeit all and any collected Travel Vouchers, including any that could have been earned in future via any offer whatsoever.
  3. If you delete your account, you will forfeit all and any collected Travel Vouchers, including any that could have been earned in future via any offer whatsoever.
  4. We reserve the right to amend, terminate, update or change entirely this promotion at any time without prior notice.
  5. Vouchers gained through this promotion will have a validity that is not exceeding 1 year from the date of granting.
  6. New members who join using an invite link or referral code will only receive a Travel Voucher if they have registered directly from the invite link or entered an eligible referral code. This promotion is for new members only. Existing members will not be able to claim a new Travel Voucher upon receipt of an invite link or referral code, in accordance with our Terms & Conditions, creating multiple accounts is prohibited and will result in those accounts being terminated and any vouchers forfeited.
  7. The Travel Voucher offered to new members who join using an invite link or referral code, will be able to use their Travel Voucher after completing their registration and any activation or confirmation processes required to validate a new membership.
  8. There are no limits to the number of people that can be invited to join the Service and / or sent an invitation or referral code.
  9. When referring the Service to a new member, a Travel Voucher is only awarded to the referring member, for the first booking made, subject to the total booking value being at least 20 times the value of the Travel Voucher received by the new member, prior to any conversion. For subsequent bookings, the referring member will not receive any additional Travel Vouchers.
  10. Only one referring member can receive a Travel Voucher once a new member joins, subject to the new member using the referring members’ invite link or referral code. If a new member receives multiple codes only the one they choose to use or the link they choose to register from will be validated.
  11. Invite links are unique and cannot be used by anyone other than the originally invited person. The referring member will not receive a Travel Voucher if someone else tries to join using the same invite link.
  12. Additionally, if you have invited others to the service and they have accepted your invitation, any Travel Voucher(s) which may be earned for referring a new member will be added to your WAYN Account and become available and valid once the first qualifying booking made by the new member has been confirmed and paid for and past any period of cancellation, making the booking non-refundable and non-cancellable.
  13. ENTIRE AGREEMENT
    These Terms of Service set out the written terms of our contract with you for the provision of the Service. If part of these Terms of Service cannot be enforced then the remainder of these Terms of Service will still apply to our relationship.
  14. LAW AND JURISDICTION
    1. These Terms of Service are governed by English law. This means that the contract between us and you allowing you to use the Service and any dispute or claim arising out of or in connection with it will be governed by English law.
    2. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.
    3. If you are a resident of an EU country other than the UK, you may also bring proceedings in your country of residence under the laws of that country.
